Hello Fellow Property Owners,
During our recent quarterly Board meeting (held on September 29th), the Board discussed potential concerns and issues about short-term (“vacation”) home rentals within Pinnacle Pointe. In addition, the Board reviewed the bylaws from neighboring HOAs (Norris Shores, Sunset Bay, and The Highlands on Norris Lake) and learned that short-term home rental (of less than 90 days) is prohibited in these communities. After careful consideration, the Board unanimously approved a proposal for an amendment to the Pinnacle Pointe HOA bylaws that closely resembles the language used by neighboring associations to address this issue.
The proposed amendment and a ballot will be mailed to association members in November along with the annual invoice for HOA dues. Association members will be asked to return their completed ballot with their annual dues payment in January. The threshold for approval of the amendment is 84 votes in favor of the amendment (⅔ majority of the Association). The Board recommends that the association members approve the following amendment to the HOA bylaws:

Article XIII
The Owner of a Lot shall have the right to lease such residential structure, only under the following conditions:
1. All leases shall be in writing, specify a minimum rental term of ninety (90) days, and be filed with the Association before occupancy of the property.
2. The lease shall be specifically subject to all Pinnacle Pointe Homeowners Association (a) Rules and Regulations, (b) Amended By-Laws, and (c) Protective and Restrictive Covenants (hereinafter referred to as the “Pinnacle Pointe Documents”). Any failure of tenant to comply with the Pinnacle Pointe Documents shall be a default under the lease.
3. The Owner shall be liable for any violation of the Pinnacle Pointe Documents committed by the Owner’s tenant, without prejudice to the Owner’s right to collect any sums paid by the owner on behalf of the tenant.
