Amendment to HOA Bylaws

The Homeowners Association Board of Directors held its quarterly meeting yesterday (March 16, 2019) and counted the voting ballots regarding the proposed Amendment to add Article XIII (#13) to the HOA Bylaws. Article #13 was proposed to permit home rentals within Pinnacle Pointe only under certain conditions (namely, the existence of a written lease for a rental term of at least 90 days). The ballot count revealed that Amendment #13 had passed with 84 Yes ballots, 21 No ballots, 19 abstentions, and 1 ballot that was not signed.

The Board passed a motion to record the Amendment with the Union County (Tennessee) Register of Deeds as soon as possible with an effective date of July 1, 2019. Accordingly, the following amended text of the Pinnacle Pointe HOA Bylaws will apply, beginning July 1, 2019:

The Owner of a Lot shall have the right to lease such residential structure, only under the following conditions:

1. All leases shall be in writing, specify a minimum rental term of ninety (90) days, and be filed with the Association before occupancy of the property.
2. The lease shall be specifically subject to all Pinnacle Pointe Homeowners Association (a) Rules and Regulations, (b) Amended By-Laws, and (c) Protective and Restrictive Covenants (hereinafter referred to as the “Pinnacle Pointe Documents”). Any failure of tenant to comply with the Pinnacle Pointe Documents shall be a default under the lease.
3. The Owner shall be liable for any violation of the Pinnacle Pointe Documents committed by the Owner’s tenant, without prejudice to the Owner’s right to collect any sums paid by the owner on behalf of the tenant.

As soon as the amended bylaws have been recorded at the courthouse, the “HOA Documents” section of this website will be updated with the newly-amended bylaws document (to include Article #13).
