*Upcoming Quarterly Board Meeting Sept 5th at 10am PPHOA Club House

Attention all members;

It has come to our attention that there is a resident in the community has become unhappy with the board and has decided to attempt to reach out to all of the home/lot owners with their concerns. Please be advised that this individual has sought legal representation and the board has been advised to have no further contact with this individual.

The issues at hand are not serious at this time and do not require any involvement or actions from the owners in PPHOA. If this person reaches out or contacts anyone, please notify the Board and keep copies of any and all correspondence between you and this individual. Only info involving HOA business and or accusations against an individual or the board needs to be kept.

To give everyone a short explanation. On the 4th of July an incident occurred involving several owners and multiple board members responding to a boat slip issue, As most of you know the marina is full and has been sense the middle of June. Our current policy for boat slips is “First Come First Use”, now here is where the confusion comes in. The Board and every owner that has ever utilized this amenity is under the same understanding that this refers to “First come first use, at the start of the season”. And we all operate accordingly with common courtesy that if you leave a slip to enjoy the day on the water, that when you return, you are still intitled to the same slip you have occupied all season, even further solidifying the slip is occupied most of us leave our buoys and or ropes attached to the slip. The problem arose when an unidentified boat was parked in a slip that was left in just such a manor. The slip was clearly occupied all season and when an unidentified vessel was found in this slip the board made the decision to relocate the boat and secure it to the end of the dock. This resident became extremely irate and confused about the standard policy and thought it was there right to remain in an occupied slip. The board members offered several alternative options to satisfy this resident and provide them a slip, to no avail it was not satisfactory.

This resident has now escalated there claims to include false accusation and legal threats against the HOA and the Board. Among some of these accusations these include theft and mismanagement of funds reaching back to the start of HOA and allegations that the board has and is currently acting out of good faith and broken the law. Also claiming we refuse to provide HOA documents and financials. This resident has also bombarded several board members and other owners with generic documentation and google or AI generated searches with results on how to go after an HOA and how to directly how to stop a rogue board and or members.

With full transparency, the board has taken the stance to have no contact with this individual from the point they threatened legal action. We want everyone to rest assured we will try our best to mediate this issue with minimal interruption and financial hardship to the community, but this will serve as a formal notice that we are retaining an attorney to deal with this matter until resolved. We would also like to respond to the accusations, although unfounded. The board has full faith in our members especially our treasurer and secretary. We have no reason to believe that any theft has occurred, or any laws have been broken any time sense the start of PPHOA. We offered this resident access to any documentation and records at our disposal, but this resident and their attorney have failed to take the proper steps to request and obtain said information. To protect the owners and their privacy as well as the HOA and our owners’ legal rights, this type of request requires specific procedures spelled out in our bylaws. Unfortunately, neither the resident nor their attorney found it applicable to follow the rules. At any time any owner here in PPHOA can review our records and meet with the board with concerns or questions. We have nothing to hide. And to address some of the outlandish stories being told, we have not changed the rules or bylaws concerning the docks, boats, pool, pavilion or clubhouse! They are NOT going to be sold or rented. Nor have we ever charged for using any of these amenities. None of these accusations have ever been mentioned by any board member at any meeting or privately! Any changes and or amendments have been voted on at the annual meeting and adopted accordingly. The only exception to this was the corrections and bylaw amendments voted on in 2024, these are not currently enacted, recorded or enforced, there status is currently on hold awaiting review from our attorney and final approval by the board before filing. We had hoped to have a plan in place to expand the dock prior to it filling up, but unfortunately we are at TVAs mercy and at this point the answer has been no!

Now were not sure exactly what this resident hopes to accomplish from all of this, but the board stands behind our decisions and we hope that the owners and residents understand and continues to support our efforts to better our small community. And again we apologize for any inconvenience this issue has brought to our peaceful summer! We will update the community of any new developments as they arise. Feel free to contact any board member and owners are always encouraged to attend the annual meeting in May or any quarterly board meeting. All meetings are posted in advance on the community calendar located at pphoa.org
